Terms and Conditions (T)
1. Scope
These Terms and Conditions (T) apply to all services provided by Gaumenkutsche, proprietor Jasmin Geraldine Egger, in the field of mobile gastronomy, catering, and event hospitality. They apply to private customers as well as companies and agencies. Deviating terms of the contracting party shall not apply unless expressly agreed in writing.
For appearances at public markets, trade fairs, or events where Gaumenkutsche operates on the basis of a stand or participation agreement with the respective organiser, the respective market, stand, or event conditions shall apply.
2. Offer and conclusion of contract
The presentation of services on the website does not constitute a binding offer. Offers from Gaumenkutsche are non-binding unless expressly stated otherwise in the respective offer.
A contract for individually agreed services (e.g. special appearances, private events, or bookings by private or commercial clients) is concluded exclusively upon written order confirmation by Gaumenkutsche.
Oral or telephone agreements require written confirmation by Gaumenkutsche to be effective.
For appearances at public markets, trade fairs, or events, a contractual relationship is not concluded via the website, but exclusively on the basis of the respective market, stand, or organiser conditions.
Amendments or additions to the contract require the written consent of both contracting parties.
Documents, concepts, or other content transmitted in connection with an offer remain the property of Gaumenkutsche and must be treated as confidential.
3. Scope of services
The type and scope of services result from the respective individual agreement. The culinary offering is coordinated in advance and defined in accordance with the respective event concept.
Changes or adjustments shall be made exclusively in coordination with the contracting party.
4. Prices and payment
All prices are agreed individually and, unless stated otherwise, are in euros.
A deposit may be required to secure the booking. The remaining balance must be paid in accordance with the agreed payment deadline.
Payment via the website is not possible.
5. Withdrawal by the contracting party (cancellation)
Withdrawal from the contract must be notified in writing. Unless expressly agreed otherwise, the following cancellation conditions apply:
- up to 21 days before the agreed date: no cancellation fee
- 20 to 15 days before the date: 30% of the agreed fee
- 14 to 7 days before the date: 50% of the agreed fee
- less than 7 days before the date or in the event of no-show: 100% of the agreed fee
Any deposits already paid will be credited accordingly.
6. Withdrawal by Gaumenkutsche
Gaumenkutsche is entitled to withdraw from the contract if force majeure makes performance impossible, agreed deposits are not paid on time, or material contractual conditions are not complied with.
Payments already received will be refunded in this case; any further claims by the contracting party are excluded insofar as legally permissible.
7. Obligations of the contracting party
The contracting party shall ensure that the agreed location is accessible, that all required official permits are in place, and that agreed electricity, water, or other connections are provided and functional.
The contracting party shall be liable for delays or additional costs resulting from failure to fulfil cooperation obligations.
8. Liability
Gaumenkutsche shall be liable only for damage attributable to intentional or grossly negligent conduct. Liability for slight negligence is excluded, except in the case of damage to life, limb, or health, insofar as legally permissible.
No liability is assumed for damage caused by external circumstances, weather conditions, official orders, or third parties.
9. Place of performance, jurisdiction and choice of law
The place of performance is the registered office of Gaumenkutsche. Austrian law shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is—where legally permissible—the court with subject-matter jurisdiction at the company’s registered office.
10. Final provisions
Should individual provisions of these T be or become invalid, the validity of the remaining provisions shall remain unaffected.
